Code, Environment § 9–229","heading":"","body":"(a) Unless the Secretary determines that a removal and remedial action will be done properly and in a timely manner by the owner or operator of a site where used tires are stored or disposed of, if used tires are stored or disposed of at a site in a manner that may present a threat to the public health or environment, the Secretary may:\n(1) Act to remove or arrange for the removal of the used tires and provide for remedial action necessary to restore any natural resources; or\n(2) Take any other response measure that the Secretary considers necessary to protect the public health or welfare or the environment.\n(b) Nothing in this section shall prohibit the Secretary from abating a nuisance under the provisions of Title 10 of this article, regardless of the volume of used tires stored.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-229","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"fe8acfe2064b4fa38b714de03af105fdfd9583f5d2c6345fcdf86b15637d6c24","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-228.1","next":"us-md/md.-code-environment-9-230"},"notice":"GroundRules: Original legal text.
