Code, Environment § 9–2405","heading":"","body":"(a) Except as provided in subsection (c) of this section, the provisions of §§ 9–334 through 9–344 of this title apply to enforce violations of:\n(1) This subtitle;\n(2) Any regulation adopted under this subtitle; or\n(3) Any order issued under this subtitle.\n(b) Any penalty collected by the Department under this section shall be paid into the Maryland Clean Water Fund established under § 9–320 of this title.\n(c) (1) A person who violates this subtitle is subject to:\n(i) A civil penalty up to $2,500 for each violation; and\n(ii) An administrative penalty up to $2,500 for each violation, but not exceeding $100,000 total.\n(2) Each day a violation occurs is a separate violation under this section.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-2405","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"a96b94ae9d5db1cac773d4089172d9753d336a50773409ac4e75bbd9e8f56cd9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-2404","next":"us-md/md.-code-environment-9-2501"},"notice":"GroundRules: Original legal text.
