Code, Environment § 9–414","heading":"","body":"(a) The Department may issue an order or notice if the Department has reasonable grounds to believe that a person to whom the order or notice is directed has violated:\n(1) This subtitle;\n(2) Any rule or regulation adopted under this subtitle; or\n(3) Any order or permit issued under this subtitle.\n(b) An order or notice issued under this subtitle shall:\n(1) Specify the provision that allegedly has been violated;\n(2) State the alleged facts that constitute the violation;\n(3) State the actions necessary to correct the violation and the time allowed for corrections; and\n(4) State the procedure for requesting a hearing to respond to the violation alleged in the order.\n(c) If the person served with an order does not request a hearing within 30 days, the order becomes a final order.\n(d) Any notice or order issued by the Department under this subtitle may be served on the person to whom it is directed:\n(1) In accordance with § 1–204 of this article; or\n(2) By publication.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-414","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"8b96feef10314c03281ba324a363ca8c1e276bda0ae296c87dbe7eed4829330c","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-413","next":"us-md/md.-code-environment-9-415"},"notice":"GroundRules: Original legal text.
