Code, Environment § 9–511.1","heading":"","body":"(a) A county may remove a proposed solid waste acceptance facility from the county plan if:\n(1) The owner of the proposed solid waste acceptance facility fails to apply to the Department for a new permit within 1 year of inclusion in the plan;\n(2) The owner of the proposed solid waste acceptance facility fails to apply to the Department for a renewal in accordance with § 10-226(b) of the State Government Article;\n(3) The Department denies a permit for the proposed solid waste acceptance facility in its final decision; or\n(4) The proposed solid waste acceptance facility is not constructed within 10 years after receiving a permit.\n(b) For the purposes of subsection (a)(1) of this section, a new permit does not include a permit application for expansion or major modification of an existing facility.\n(c) This section may not be construed to allow the county to remove a proposed solid waste acceptance facility if the solid waste acceptance facility is necessary to provide adequate capacity for the disposal of solid waste generated within the county in accordance with § 9-505 of this subtitle.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-511.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"b03d3f4180e86ae68dddbac73a75e5a321fc7008c9614c2625eeecc291ba9109","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-511","next":"us-md/md.-code-environment-9-512"},"notice":"GroundRules: Original legal text.
