Code, Environment § 9–617","heading":"","body":"(a) In this section, “corporate document” means:\n(1) Articles of incorporation;\n(2) Articles of amendment;\n(3) Articles of joinder; or\n(4) Articles of withdrawal.\n(b) (1) When a corporate document is filed with it, the State Department of Assessments and Taxation shall:\n(i) Endorse on the corporate document the time and date the corporate document was received; and\n(ii) Examine the corporate document.\n(2) If, after examination, the State Department of Assessments and Taxation determines that the corporate document is proper, the State Department of Assessments and Taxation shall:\n(i) Issue a certificate of approval;\n(ii) Include with the certificate of approval a copy of the corporate document; and\n(iii) Record a copy of:\n1. The corporate document; and\n2. The certificate of approval.\n(c) When the State Department of Assessments and Taxation issues a certificate of approval under this section:\n(1) The corporate document is effective;\n(2) The district exists as provided in the corporate document; and\n(3) The corporate document is conclusively presumed to have been adopted lawfully.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-617","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"1c8ee73c4790611c0a8a7c1199bf3eb6f07581ddf044b8a2eb4c81727b71383b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-616","next":"us-md/md.-code-environment-9-618"},"notice":"GroundRules: Original legal text.
