Code, Environment § 9–664","heading":"","body":"(a) An independent system may be constructed in accordance with this section:\n(1) By a member county at its own expense; or\n(2) By and at the expense of the owners of property that will be served by the independent system.\n(b) A person or member county may construct an independent system only if:\n(1) The independent system will serve an area that is not served by a project or a municipal system; and\n(2) The sanitary commission approves.\n(c) The person or member county that proposes to construct the independent system shall:\n(1) Submit to the sanitary commission plans and specifications for construction of the independent system; and\n(2) If the sanitary commission approves the plans and specifications, construct the independent system in accordance with the approved plans and specifications.\n(d) Each independent system shall be operated:\n(1) At the expense of the person or county that constructs it; and\n(2) Under the general supervision of the sanitary commission.\n(e) The person or county that constructs an independent system shall:\n(1) Keep accurate records of:\n(i) The construction of the independent system;\n(ii) The operation of the independent system; and\n(iii) The cost of building and operating the independent system; and\n(2) File copies of the records with the sanitary commission.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-664","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"c07f497713442ff34ff80fa8d45b2aa5707fe02ac9bdd561b6973c19af21728d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-663","next":"us-md/md.-code-environment-9-665"},"notice":"GroundRules: Original legal text.
