Code, Estates and Trusts § 14.5–807","heading":"","body":"(a) (1) A trustee may delegate duties and powers that a prudent trustee of comparable skills could properly delegate under the circumstances to an agent, even if the agent is associated with the trustee.\n(2) A trustee shall exercise reasonable care, skill, and caution in:\n(i) Selecting an agent;\n(ii) Establishing the scope and terms of the delegation, consistent with the purposes and terms of the trust; and\n(iii) Periodically reviewing the actions of the agent in order to monitor the performance of the agent and compliance with the terms of the delegation by the agent.\n(b) In performing a delegated function, an agent owes a duty to the trust to exercise reasonable care to comply with the terms of the delegation.\n(c) By accepting a delegation of powers or duties from the trustee of a trust that is subject to the laws of this State, an agent submits to the jurisdiction of the courts of this State.\n(d) This section does not apply to a delegation of investment duties or powers in accordance with § 15–114 of this article.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=14.5-807","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"335b27aba0fa03f574e542d6608922cde17147836aabba56bbf02a62a81c2a1a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-14.5-806","next":"us-md/md.-code-estates-and-trusts-14.5-808"},"notice":"GroundRules: Original legal text.
