Code, Estates and Trusts § 14.5–815","heading":"","body":"(a) A trustee, without authorization by the court, may exercise:\n(1) Powers conferred by the terms of the trust; or\n(2) Except as limited by the terms of the trust:\n(i) All powers over the trust property that an unmarried competent owner has over individually owned property;\n(ii) Other powers appropriate to achieve the proper investment, management, and distribution of the trust property; and\n(iii) Other powers conferred by this title or Title 15, Subtitle 6 of this article.\n(b) The exercise of a power described in subsection (a) of this section is subject to the fiduciary duties prescribed by this title.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=14.5-815","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"6ed165114353ab6b3f8b56a77f2a55023342918c7fd87507b2f6c6fcb9cd2fe6","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-14.5-814","next":"us-md/md.-code-estates-and-trusts-14.5-816"},"notice":"GroundRules: Original legal text.
