Code, Estates and Trusts § 14.5–901","heading":"","body":"(a) (1) A violation by a trustee of a duty the trustee owes to a beneficiary is a breach of trust.\n(2) A breach of trust under this subsection may occur by reason of an action or by reason of a failure to act.\n(b) To remedy a breach of trust by the trustee that has occurred or may occur, the court may:\n(1) Compel the trustee to perform the duties of the trustee;\n(2) Enjoin the trustee from committing a breach of trust;\n(3) Compel the trustee to redress a breach of trust by paying money, restoring property, or other means;\n(4) Order a trustee to account;\n(5) Appoint a special fiduciary to take possession of the trust property and administer the trust;\n(6) Suspend the trustee;\n(7) Remove the trustee as provided in § 14.5–706 of this title;\n(8) Reduce or deny compensation to the trustee;\n(9) Subject to § 14.5–909 of this subtitle, void an act of the trustee, impose a lien or a constructive trust on trust property, or trace trust property wrongfully disposed of and recover the property or proceeds from the property; or\n(10) Order other appropriate relief.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=14.5-901","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"dcc90739fecaa9829d447d99c6feb2f9d7f4eba1b2fc442cc1259dc9e5951149","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-14.5-817","next":"us-md/md.-code-estates-and-trusts-14.5-902"},"notice":"GroundRules: Original legal text.
