Code, Estates and Trusts § 14.5–902","heading":"","body":"(a) A trustee that commits a breach of trust is liable to the beneficiaries affected by the breach for the greater of:\n(1) The amount required to restore the value of the trust property and trust distributions to what they would have been had the breach not occurred; or\n(2) The profit the trustee made by reason of the breach.\n(b) (1) Except as otherwise provided in this subsection, if more than one trustee is liable to the beneficiaries for a breach of trust, a trustee is entitled to contribution from the other trustee or trustees that are also liable.\n(2) A trustee that received a benefit from a breach of trust under this subsection is not entitled to contribution from another trustee to the extent of the benefit received.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=14.5-902","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"8bb1be1acfb6967f78741ffd213bedcb6a96f4d97597e78c3c4a19ed43c4c244","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-14.5-901","next":"us-md/md.-code-estates-and-trusts-14.5-903"},"notice":"GroundRules: Original legal text.
