Code, Estates and Trusts § 15–112","heading":"","body":"(a) (1) A court shall remove a fiduciary who has:\n(i) Willfully misrepresented material facts leading to the appointment of the fiduciary or to other action by the court in reference to the fiduciary estate;\n(ii) Willfully disregarded an order of court;\n(iii) Shown to be incapable, with or without fault to properly perform the duties of the office of fiduciary; or\n(iv) Breached the fiduciary duty of good faith or loyalty in the management of property of the fiduciary estate.\n(2) A court may remove a fiduciary who has:\n(i) Negligently failed to file a bond within the time required by rule or order of court;\n(ii) Negligently failed to obey an order of court; or\n(iii) Failed to perform any fiduciary duty, or to competently administer the fiduciary estate.\n(b) Procedures for the removal of a fiduciary shall be conducted by the court in accordance with the provisions of the Maryland Rules applying to a fiduciary.\n(c) The provisions of this section may not apply to personal representatives.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=15-112","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"9d1f3681e5f77b7a77a6c5a4ed84b1ec396fe08e0a8d9ebf47d179b737207566","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-15-111","next":"us-md/md.-code-estates-and-trusts-15-113"},"notice":"GroundRules: Original legal text.
