Code, Estates and Trusts § 15–608","heading":"","body":"To the extent that a power of attorney expressly grants an agent authority over the content of electronic communications sent or received by the principal and unless directed otherwise by the principal or a court, a custodian shall disclose to the agent the content if the agent provides the custodian:\n(1) A written request for disclosure in a physical or electronic form;\n(2) An original or copy of the power of attorney expressly granting the agent authority over the content of electronic communications of the principal;\n(3) A certification by the agent, under penalty of perjury, that the power of attorney is in effect; and\n(4) If requested by the custodian:\n(i) A number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the principal’s account; or\n(ii) Evidence linking the account to the principal.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=15-608","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"2d8724a810288e57f082b5796beafec1ffb42e1e518d5e79165f35605cbfc674","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-15-607","next":"us-md/md.-code-estates-and-trusts-15-609"},"notice":"GroundRules: Original legal text.
