Code, Estates and Trusts § 3–407","heading":"","body":"(a) (1) The election by a surviving spouse to take an elective share shall be made within the later of:\n(i) 9 months after the date of the decedent’s death; or\n(ii) 6 months after the first appointment of a personal representative.\n(2) (i) Within the period for making an election, the surviving spouse may file with the court a petition for an extension of time, with a copy given to the personal representative.\n(ii) For good cause shown, the court may extend the time for election for a period not to exceed 3 months at a time.\n(b) The surviving spouse may withdraw the election at any time before the expiration of the time for making the election to take an elective share.","path":["Article - Estates and Trusts"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=get\u0026section=3-407","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:07Z","sha256":"9ccb66ee223a868401fc3d285c21a372ed6d83b1c55ff1eb1d27ffd6bb6ce9e7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-estates-and-trusts-3-406","next":"us-md/md.-code-estates-and-trusts-3-408"},"notice":"GroundRules: Original legal text.
