Code, Financial Institutions § 12–1003","heading":"","body":"This subtitle does not apply to:\n(1) The following persons when engaged in the regular course of their respective businesses and professions:\n(i) An attorney at law who is admitted to the Maryland Bar while the attorney at law is providing professional legal services in an attorney–client relationship;\n(ii) An escrow agent;\n(iii) A certified public accountant;\n(iv) A banking institution, other–state bank, national banking association, credit union, or savings and loan association;\n(v) A person that:\n1. Provides a bill payer service, as defined in § 12–401 of this title;\n2. Does not initiate any contract with individual creditors of a debtor to compromise a debt or arrange a new payment schedule; and\n3. Does not provide any debt counseling services;\n(vi) A person that provides an accelerated mortgage payment service, as defined in § 12–401 of this title;\n(vii) A title insurer, title insurance agency, or abstract company; or\n(viii) A judicial officer or a person acting under a court order;\n(2) A person while performing services incidental to the dissolution, winding up, or liquidation of a partnership, corporation, or other business enterprise;\n(3) A trade or mercantile association acting in the course of arranging the adjustment of debts with a business establishment;\n(4) (i) A mortgage lender, as defined in § 11–501 of this article:\n1. That is licensed by the Commissioner; and\n2. While engaged in the mortgage lending business, as defined in § 11–501 of this article; or\n(ii) An employee of a mortgage lender; or\n(5) A collection agency, as defined in § 7–101 of the Business Regulation Article:\n(i) That is licensed by the State Collection Agency Licensing Board; and\n(ii) While engaged in the collection agency business, as defined in § 7–101 of the Business Regulation Article.","path":["Article - Financial Institutions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gfi\u0026section=12-1003","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:27Z","sha256":"9df7636d154cc1d540184b0710c2c4988bdb30db50ffdd7b55345974acf96568","source_id":"us-md","stale":false,"prev":"us-md/md.-code-financial-institutions-12-1002","next":"us-md/md.-code-financial-institutions-12-1004"},"notice":"GroundRules: Original legal text.
