Code, Financial Institutions § 12–902","heading":"","body":"This subtitle does not apply to:\n(1) The following persons when engaged in the regular course of their respective businesses and professions:\n(i) An attorney at law;\n(ii) An escrow agent;\n(iii) A certified public accountant;\n(iv) A banking institution, other-state bank, national banking association, credit union, or savings and loan association;\n(v) A person that:\n1. Provides bill payer services, as defined in § 12-401 of this title;\n2. Does not initiate any contract with individual creditors of the debtor to compromise a debt or arrange a new payment schedule; and\n3. Does not provide any debt counseling services;\n(vi) A person that provides accelerated mortgage payment services, as defined in § 12-401 of this title;\n(vii) A title insurer, title insurance agency, or abstract company; or\n(viii) A judicial officer or a person acting under a court order;\n(2) A person while performing services incidental to the dissolution, winding up, or liquidation of a partnership, corporation, or other business enterprise;\n(3) A trade or mercantile association acting in the course of arranging the adjustment of debts with a business establishment; or\n(4) A mortgage lender, as defined in § 11-501 of this article, that:\n(i) Is licensed by the Commissioner; and\n(ii) Does not receive funds from a consumer for the purpose of distributing the funds among the consumer’s creditors in full or partial payment of the consumer’s debts.","path":["Article - Financial Institutions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gfi\u0026section=12-902","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:27Z","sha256":"5edea7b8c118f684e52a1ee32161f7cab1ef3cc9c862481f6411ef1bf49e6a2c","source_id":"us-md","stale":false,"prev":"us-md/md.-code-financial-institutions-12-901","next":"us-md/md.-code-financial-institutions-12-904"},"notice":"GroundRules: Original legal text.
