Code, Financial Institutions § 5–1003","heading":"","body":"(a) A banking institution or an out–of–state bank may establish a branch in this State by:\n(1) Subject to subsection (b) of this section, opening a de novo branch;\n(2) Purchasing an existing branch from a bank or an insured depository institution; or\n(3) Converting former headquarters or retaining former branches following:\n(i) The purchase of all or substantially all of the assets of a bank or an insured depository institution; or\n(ii) A merger or a consolidation with a bank or an insured depository institution.\n(b) An out–of–state bank may establish a de novo branch in this State under subsection (a)(1) of this section only if the home state of the out–of–state bank allows a banking institution to open a de novo branch in its state.\n(c) A banking institution or an out–of–state bank may not establish or maintain a branch in this State on the premises or property of an affiliate if the affiliate engages in commercial activities.","path":["Article - Financial Institutions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gfi\u0026section=5-1003","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:27Z","sha256":"502fe9e1e3c5064113e66a05af4dd73d8c22b6311ea913b2925bd93d7977736f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-financial-institutions-5-1002","next":"us-md/md.-code-financial-institutions-5-1004"},"notice":"GroundRules: Original legal text.
