Code, General Provisions § 4–311","heading":"","body":"(a) Subject to subsection (b) of this section, a custodian shall deny inspection of a personnel record of an individual, including an application, a performance rating, or scholastic achievement information.\n(b) A custodian shall allow inspection by:\n(1) the person in interest;\n(2) an elected or appointed official who supervises the work of the individual; or\n(3) an employee organization described in Title 6 of the Education Article of the portion of the personnel record that contains the individual’s:\n(i) home address;\n(ii) home telephone number; and\n(iii) personal cell phone number.\n(c) (1) Except as provided in paragraph (2) of this subsection, the following records are not personnel records for the purposes of this section:\n(i) a record relating to an administrative or criminal investigation of misconduct by a police officer, including an internal affairs investigatory record;\n(ii) a hearing record;\n(iii) a record of positive community feedback that was not solicited by the police officer who is the subject of the feedback; and\n(iv) records relating to a disciplinary decision.\n(2) A record of a technical infraction is a personnel record for the purposes of this section.","path":["Article - General Provisions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ggp\u0026section=4-311","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:37Z","sha256":"ba0e53aeb3e4da99f79b39e79f1a24a875f632e575e3b52185cdfb96f2a2f2a5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-general-provisions-4-310","next":"us-md/md.-code-general-provisions-4-312"},"notice":"GroundRules: Original legal text.
