Code, General Provisions § 4–329","heading":"","body":"(a) Except for subsection (b)(3) of this section, this section does not apply to:\n(1) a nursing home as defined in § 19–1401 of the Health – General Article; or\n(2) an assisted living program as defined in § 19–1801 of the Health – General Article.\n(b) Subject to subsection (c) of this section, a custodian shall deny inspection of the part of a public record that contains:\n(1) medical or psychological information about an individual, other than an autopsy report of a medical examiner;\n(2) personal information about an individual with, or perceived to have, a disability as defined in § 20–701 of the State Government Article; or\n(3) any report on human immunodeficiency virus or acquired immunodeficiency syndrome submitted in accordance with Title 18 of the Health – General Article.\n(c) A custodian shall allow the person in interest to inspect the public record to the extent allowed under § 4–304(a) of the Health – General Article.","path":["Article - General Provisions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ggp\u0026section=4-329","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:37Z","sha256":"8a751cd076a5e032dd70b5179eb8f581e23a4bb2532b5fcb5b7fb5a2a797ec36","source_id":"us-md","stale":false,"prev":"us-md/md.-code-general-provisions-4-328","next":"us-md/md.-code-general-provisions-4-330"},"notice":"GroundRules: Original legal text.
