Code, General Provisions § 5–208","heading":"","body":"(a) With advice from the Secretary of Budget and Management and in accordance with § 5–103 of this title, the Ethics Commission shall determine whether an individual in an executive unit is a public official for the purposes of this title.\n(b) The Secretary of Budget and Management shall provide advice under subsection (a) of this section to the Ethics Commission:\n(1) annually; and\n(2) at any other time on request of the Ethics Commission.\n(c) On request of the Ethics Commission, the following entities shall provide to the Ethics Commission in a timely manner any information necessary for the Ethics Commission to make a determination under subsection (a) of this section:\n(1) the secretary of a principal department in the Executive Branch;\n(2) the president of a public senior higher education institution, as defined in § 10–101 of the Education Article; and\n(3) a unit of State government.","path":["Article - General Provisions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ggp\u0026section=5-208","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:37Z","sha256":"9e6164456e229bee5a256e11e40493d5c2955ff38946244cc68fbe3a3c6c731e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-general-provisions-5-207","next":"us-md/md.-code-general-provisions-5-209"},"notice":"GroundRules: Original legal text.
