Code, General Provisions § 5–902","heading":"","body":"(a) The court may compel compliance with the Ethics Commission’s order by:\n(1) issuing an order to cease and desist from the violation; or\n(2) granting other injunctive relief.\n(b) (1) The court may also:\n(i) impose a fine:\n1. not exceeding $5,000 for a violation of this title;\n2. with each day that the violation occurs being a separate offense; and\n3. which shall be paid to the State Treasurer and deposited in the General Fund; or\n(ii) except as provided in paragraph (2) of this subsection, void an official act of an official or employee if:\n1. the official or employee had a conflict of interest that is prohibited by this title;\n2. the act arose from or concerned the subject matter of the conflict;\n3. the proceeding was brought within 90 days after the act occurred; and\n4. the court determines that the conflict had an impact on the act.\n(2) The court may not void an official act that:\n(i) appropriates public funds;\n(ii) imposes a tax; or\n(iii) provides for the issuance of a bond, a note, or any other evidence of public obligation.\n(c) After hearing the case, the court may grant all or part of the relief sought.","path":["Article - General Provisions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ggp\u0026section=5-902","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:37Z","sha256":"fb2bc1c60adf5bff484eb1bcc0a22d95718b7b604b2050eb655e2f21a5e6b01f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-general-provisions-5-901","next":"us-md/md.-code-general-provisions-5-903"},"notice":"GroundRules: Original legal text.
