Code, Health - General § 19–1404","heading":"","body":"(a) A civil money penalty imposed under this section for potential for more than minimal harm deficiencies:\n(1) May not exceed $10,000 per instance; or\n(2) May not exceed $1,000 per day for an ongoing pattern of deficiencies until the nursing home is in compliance.\n(b) A civil money penalty imposed under this subtitle for actual harm deficiencies:\n(1) May not exceed $10,000 per instance; or\n(2) May not exceed $5,000 per day for an ongoing pattern of deficiencies until the nursing home is in compliance.\n(c) A civil money penalty imposed under this section for a serious and immediate threat:\n(1) May not exceed $10,000 per instance; or\n(2) May not exceed $10,000 per day for an ongoing pattern of deficiencies until the nursing home is in compliance.\n(d) In setting the amount of a civil money penalty under this section, the Secretary shall consider, pursuant to guidelines set forth in regulations promulgated by the Secretary, the following factors:\n(1) The number, nature, and seriousness of the deficiencies;\n(2) The degree of risk to the health, life, or safety of the residents of the nursing home caused by the deficiency or deficiencies;\n(3) The efforts made by the nursing home to correct the deficiency or deficiencies;\n(4) Current federal guidelines for money penalties;\n(5) Whether the amount of the proposed civil money penalty will jeopardize the financial ability of the nursing home to continue operating as a nursing home; and\n(6) Such other factors as justice may require.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=19-1404","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"cc1e8dba414bd9b18c641aefb5a12fa782cfedf8c9df4c336fac75a0f7678f85","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-19-1403","next":"us-md/md.-code-health-general-19-1405"},"notice":"GroundRules: Original legal text.
