Code, Health - General § 19–1415","heading":"","body":"(a) In this section, “change in condition” means a significant change in the resident’s physical, mental, or psychological status including:\n(1) Life-threatening conditions such as heart attack or stroke;\n(2) Clinical complications such as:\n(i) Development of a pressure sore;\n(ii) Onset of recurrent periods of delirium;\n(iii) Onset of recurrent urinary tract infection;\n(iv) Onset of depression; or\n(v) Onset of aggressive or inappropriate behavior;\n(3) The need to discontinue a medication or treatment because of:\n(i) Adverse consequences; or\n(ii) The need to begin a new form of treatment;\n(4) Evaluation at or admission to a hospital; and\n(5) Accidents that result in injury having the potential for requiring a physician’s intervention.\n(b) Consistent with State and federal confidentiality laws and in a timely manner, a nursing home shall notify a resident and, if applicable, the resident’s representative or interested family member of any:\n(1) Change in condition;\n(2) Adverse event that may result in a change in condition;\n(3) Outcome or care that results in an unanticipated consequence; or\n(4) Corrective action, if appropriate.\n(c) If the Department determines that a nursing home failed to notify a resident, resident’s representative, or interested family member under subsection (b) of this section, the Department shall require as part of a plan of correction that the nursing home notify the resident, the resident’s representative, or interested family member as soon as possible.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=19-1415","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"181eca04d259addf18571c44326f83957dfdc027c48be2712716a5ad8152f32d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-19-1414","next":"us-md/md.-code-health-general-19-1416"},"notice":"GroundRules: Original legal text.
