Code, Health - General § 19–7A–03","heading":"","body":"(a) (1) Before an entity may operate as a provider-sponsored organization under the federal Medicare+Choice Program, the entity must obtain a license from the Commissioner.\n(2) The Commissioner shall issue a license under paragraph (1) of this subsection to any entity to operate as a provider-sponsored organization that meets the requirements of subsection (b) of this section.\n(b) To operate as a provider-sponsored organization under the federal Medicare+Choice Program in this State, an entity shall:\n(1) Meet the definition of a provider-sponsored organization under § 19-7A-01 of this subtitle; and\n(2) Meet the requirements applicable to a health maintenance organization under Subtitle 7 of this title to the extent those requirements are not preempted by federal law.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=19-7A-03","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"c3749e0b06511948e1795e376b3559d5d9ae677bcbe514e03a8dac18f63d6427","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-19-7a-02","next":"us-md/md.-code-health-general-19-7a-04"},"notice":"GroundRules: Original legal text.
