Code, Health - General § 20–307","heading":"","body":"(a) The Secretary may investigate any suspected nuisance.\n(b) (1) If the Secretary finds that a nuisance exists, the Secretary shall serve a written notice to the person who is causing the nuisance, ordering the person to abate the nuisance within a time specified in the notice.\n(2) The notice shall be served:\n(i) On the person who is causing the nuisance; or\n(ii) If the person who is causing the nuisance cannot be found, on the owner or occupant of the property where the nuisance exists.\n(c) (1) The Secretary may file a complaint in the circuit court for the county where the nuisance exists if:\n(i) The person served with the notice fails to comply with the requirements of the notice; or\n(ii) Although the person served complies with the requirements of the notice, the nuisance is likely to recur on the same property.\n(2) A complaint filed under this subsection may seek a court order requiring the person served with the notice to:\n(i) Comply with the requirements of the Secretary’s abatement notice;\n(ii) Abate the nuisance within a time specified in the order;\n(iii) Prevent the nuisance from recurring; or\n(iv) Pay a fine of not more than $1,000.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=20-307","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"8824b478bba9601772f0ebe7143be727d6c2ff433eac0592247f9fda2e30dec2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-20-306","next":"us-md/md.-code-health-general-20-308"},"notice":"GroundRules: Original legal text.
