Code, Health - General § 21–2A–08","heading":"","body":"(a) With respect to the administration and operation of the Program, the Department and its agents and employees are not subject to liability arising from:\n(1) The inaccuracy of any information submitted to the Program in accordance with this subtitle; or\n(2) The unauthorized use or disclosure of prescription monitoring data or naloxone medication data by a person to whom the Program was authorized to provide prescription monitoring data or naloxone medication data under this subtitle.\n(b) Except as provided in § 21–2A–09(b)(3) of this subtitle, a prescriber, prescriber delegate, pharmacist, or pharmacist delegate, acting in good faith, is not subject to liability or disciplinary action arising solely from:\n(1) Requesting or receiving, or failing to request or receive, prescription monitoring data from the Program; or\n(2) Acting, or failing to act, on the basis of prescription monitoring data provided by the Program.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=21-2A-08","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"b6b2611e0303c1c5baf1c1a671439ea30f694d9e1689ab5c8381b6be6152b76b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-21-2a-07","next":"us-md/md.-code-health-general-21-2a-09"},"notice":"GroundRules: Original legal text.
