Code, Health - General § 21–311","heading":"","body":"(a) The Department may deny an application for a food establishment license issued under this subtitle if the Department finds that the applicant:\n(1) Does not meet the requirements of this subtitle or any rules or regulations adopted under this subtitle; or\n(2) Fraudulently or deceptively attempts to obtain a license.\n(b) Within 30 days of receipt of the completed application, the Department shall notify the applicant in writing:\n(1) That the application has been denied;\n(2) The specific reasons for the denial of the application; and\n(3) If any, the actions that must be taken by the applicant to qualify for a license.\n(c) After a notice of denial is issued, the Department may issue a license to an applicant if the applicant:\n(1) Takes all actions specified in the notice of denial; and\n(2) Meets the requirements of this subtitle and all rules and regulations adopted under this subtitle.\n(d) An applicant who is denied a license is entitled to:\n(1) A hearing before the Secretary under § 21-316 of this subtitle; and\n(2) Judicial review under § 21-317 of this subtitle.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=21-311","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"375d797e3bab634e8603ca0bd2cf08917cd72b265d56c3695e991aece7655c91","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-21-310","next":"us-md/md.-code-health-general-21-312"},"notice":"GroundRules: Original legal text.
