Code, Health - General § 21–325","heading":"","body":"(a) Subject to subsection (d) of this section, each food establishment shall have:\n(1) A convenient toilet that is:\n(i) Except as provided in subsection (c) of this section, separated from any room in which food is manufactured, prepared, packed, canned, frozen, sold, or distributed;\n(ii) Kept in a sanitary condition; and\n(iii) Properly ventilated; and\n(2) A convenient lavatory that is:\n(i) Supplied with soap, water, towels, or other approved hand drying devices;\n(ii) Kept in a sanitary condition; and\n(iii) Properly ventilated.\n(b) Each food service facility which prepares food and provides seating for patrons established after January 1, 1979, shall have available for the public:\n(1) A convenient toilet that is kept in a sanitary condition; and\n(2) A convenient lavatory that is:\n(i) Supplied with soap, water, towels, or other approved hand drying devices;\n(ii) Kept in a sanitary condition; and\n(iii) Properly ventilated.\n(c) A room that houses a toilet may be constructed within a larger room in which food is manufactured, prepared, packed, canned, frozen, sold, or distributed.\n(d) (1) This subsection applies only to a food establishment that is:\n(i) A business that conducts agritourism, as defined in § 4–212 of the Land Use Article;\n(ii) A Class 4 limited winery licensed under § 2–206 of the Alcoholic Beverages and Cannabis Article; and\n(iii) A Class 8 farm brewery licensed under § 2–210 of the Alcoholic Beverages and Cannabis Article.\n(2) A food establishment may comply with the requirement to provide a convenient lavatory by providing a portable chemical toilet that:\n(i) Otherwise meets the requirements of subsection (a)(2) or (b)(2) of this section; and\n(ii) Is placed at least 25 feet from a well.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=21-325","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"996032f76ba923b5e830e70a3c27161e9aaab1b331b9f49209ee1e7c5309838f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-21-324.1","next":"us-md/md.-code-health-general-21-326"},"notice":"GroundRules: Original legal text.
