Code, Health - General § 21–410","heading":"","body":"(a) Except as otherwise provided in this section, a person shall obtain a permit with a Grade A or a manufactured grade classification from the Secretary before that person may:\n(1) Bring, send, or receive a milk product into this State for sale;\n(2) Offer a milk product for sale;\n(3) Give a milk product away;\n(4) Store a milk product; or\n(5) Transport a milk product.\n(b) A permit is required to:\n(1) Be a bobtailer;\n(2) Be a bulk milk hauler/sampler;\n(3) Be a certified industry dairy farm inspector;\n(4) Be a milk processor;\n(5) Be a milk processor – farmstead cheese producer;\n(6) Be a milk producer;\n(7) Operate a distribution station;\n(8) Operate a milk transportation company;\n(9) Operate a receiving station; or\n(10) Operate a transfer station.\n(c) A permit is not required for:\n(1) A milk producer who is outside the departmental inspection area if the raw milk from that milk producer is processed by a milk processor who holds a permit issued under this subtitle;\n(2) A bulk milk hauler/sampler who receives raw milk from outside the departmental inspection area;\n(3) A grocery store, restaurant, soda fountain, or similar establishment where milk products are served or sold at retail if:\n(i) The establishment complies with all applicable provisions of this subtitle and all applicable rules or regulations adopted under this subtitle; and\n(ii) The milk product is received from a permit holder; or\n(4) A bulk milk hauler/sampler who is transporting a sealed tanker and not producers’ samples.\n(d) The Secretary shall designate all permits with one of the following classifications, as required by rules and regulations:\n(1) Grade A milk; or\n(2) Manufactured milk.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=21-410","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"a163c6bc34db4000500f72b04cc886936e91942f1692c66a99f0fd72e4d90dda","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-21-407","next":"us-md/md.-code-health-general-21-411"},"notice":"GroundRules: Original legal text.
