Code, Health - General § 22–406","heading":"","body":"(a) A guaranty under this section may be:\n(1) A separate guaranty that specifically designates the product, fabric, or related material; or\n(2) A continuing guaranty that:\n(i) Is given by a seller to a buyer;\n(ii) Applies to any product, fabric, or related material sold to the buyer; and\n(iii) Is in the form the Department approves.\n(b) A person may not manufacture, sell, or hold with intent to sell any new or unused product that does not comply with the flammability requirements of this subtitle.\n(c) A person may not give a false guaranty.\n(d) This section does not apply to a person who:\n(1) Receives in good faith a product, fabric, or related material that is covered by a guaranty that is signed by and contains the name and address of the person who manufactured the product, fabric, or related material or from whom it was received;\n(2) Has not altered the flammability of the product, fabric, or related material covered by the guaranty; and\n(3) Reasonably and in good faith relies on the guaranty.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=22-406","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"fef1ba3992faa985ddd3d768ffc482d480baef213f59a66df224acb25e04a216","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-22-405","next":"us-md/md.-code-health-general-22-407"},"notice":"GroundRules: Original legal text.
