Code, Health - General § 5–202","heading":"","body":"(a) An individual is dead if, based on ordinary standards of medical practice, the individual has sustained either:\n(1) Irreversible cessation of circulatory and respiratory functions; or\n(2) Irreversible cessation of all functions of the entire brain, including the brain stem.\n(b) (1) This subsection does not apply to the removal of a vital organ while the individual is alive, if the individual gives informed consent to the removal.\n(2) A pronouncement of death under this section shall be made before any vital organ is removed for transplantation.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=5-202","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"01492b38b5d43d6233de1a6618e77dad87328c2d3ca888c9d3640d59a276d53c","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-5-201","next":"us-md/md.-code-health-general-5-301"},"notice":"GroundRules: Original legal text.
