Code, Health - General § 5–613","heading":"","body":"(a) A health care provider that intends not to comply with an instruction of a health care agent or a surrogate shall:\n(1) Inform the person giving the instruction that:\n(i) The health care provider declines to carry out the instruction;\n(ii) The person may request a transfer to another health care provider; and\n(iii) The health care provider will make every reasonable effort to transfer the patient to another health care provider;\n(2) Assist in the transfer; and\n(3) Pending the transfer, comply with an instruction of a competent individual, or of a health care agent or surrogate for an individual who is incapable of making an informed decision, if a failure to comply with the instruction would likely result in the death of the individual.\n(b) Nothing in this section authorizes a health care provider to provide health care to:\n(1) A competent individual over the objection of that individual; or\n(2) An individual incapable of making an informed decision over the objection of another person authorized by law to consent to the provision of health care for the individual.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=5-613","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"c0b92196930e8d9d1dd9d9f2b7191123caf96093844992cc982970c51a42ba2f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-5-612","next":"us-md/md.-code-health-general-5-614"},"notice":"GroundRules: Original legal text.
