Code, Health - General § 7–1103","heading":"","body":"(a) In this section, “custodian” means:\n(1) Executive officer or administrative head of a licensee, as defined in § 7-1001 of this title;\n(2) An individual who is responsible for the area where records on individuals who are served by a licensee, as defined in § 7-1001 of this title, are kept; or\n(3) Any individual who has or controls the record.\n(b) In addition to any damages recoverable in a court of general jurisdiction, a custodian of a record who discloses the record in violation of § 7-1010 of this title is liable to the individual whose records are disclosed unlawfully for punitive damages in an amount that does not exceed $500 plus reasonable attorney’s fees.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=7-1103","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"8b618d01d60e6a7b55f20e117ca00927c60501bb3e1787099721fe65b46dc41e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-7-1102","next":"us-md/md.-code-health-general-7-1104"},"notice":"GroundRules: Original legal text.
