Code, Health - General § 7–502","heading":"","body":"(a) The Secretary shall approve the admission of an individual to a State residential center only if:\n(1) The findings of the evaluation are that the individual:\n(i) Has an intellectual disability; and\n(ii) For adequate habilitation, needs residential services; and\n(2) There is no less restrictive setting in which the needed services can be provided and that is available to the individual or will be available to the individual within a reasonable time.\n(b) The Secretary may not approve the admission of an individual to a State residential center if:\n(1) The findings of the evaluation are that the individual:\n(i) Does not have an intellectual disability; or\n(ii) Has an intellectual disability but does not need residential services for adequate habilitation; or\n(2) There is a less restrictive setting in which the needed services can be provided that is available to the individual or will be available to the individual within a reasonable time.\n(c) The Secretary shall provide an individual with the appropriate least restrictive service consistent with the individual’s welfare, safety, and plan of habilitation, if the individual:\n(1) Has an application for services that has been approved under § 7–404(c) of this title; or\n(2) Is considered eligible for transfer under Subtitle 8 of this title by the Deputy Secretary or the Deputy Secretary’s designee.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=7-502","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"9c099172ed5cccf392ac85b69ad201f106a6c7e47dd6461384e9317963495d8e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-7-501","next":"us-md/md.-code-health-general-7-503"},"notice":"GroundRules: Original legal text.
