Code, Health - General § 7–609","heading":"","body":"To qualify for a certificate of approval, an applicant shall satisfy the Secretary that:\n(1) The proposed private group home is consistent with the State plan;\n(2) The applicant is a proper person to receive a certificate of approval;\n(3) The proposed private group home is appropriate for the stated purpose;\n(4) The proposed private group home meets or, on completion, will meet the licensing requirements of Subtitle 9 of this title;\n(5) The proposed private group home meets or, on completion, will meet all of the general zoning requirements that apply to the site and that relate to:\n(i) The height and size of any buildings that are involved;\n(ii) The land that may be covered or occupied;\n(iii) The open space requirements;\n(iv) The density requirements; and\n(v) The use of any land or buildings; and\n(6) The applicant’s facilities meet the federal regulation requirements on program accessibility (45 C.F.R. §§ 84.21 through 84.23).","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=7-609","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"960c0e099099bab54dc847f22998f1f7c2b0570d029f0813caae1a1207dfbb0d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-7-608","next":"us-md/md.-code-health-general-7-610"},"notice":"GroundRules: Original legal text.
