Code, Health - General § 7–803","heading":"","body":"(a) In this section, the term “facility” means an intermediate care facility–intellectual disability consistent with § 1905(d) of the Social Security Act.\n(b) A resident of a facility may not be transferred or discharged from the facility involuntarily except for the following reasons:\n(1) A medical reason;\n(2) The welfare of the resident or other residents;\n(3) Knowingly transferring personal assets in violation of a contract provision and only to become eligible for Medicaid benefits;\n(4) A nonpayment for a stay; or\n(5) The planned closing of the facility.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=7-803","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"ce1cfe5932e1b6866d3a0bf7c282de17c346d3c7fcc302b02dbb4f7dac9f09cc","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-7-802","next":"us-md/md.-code-health-general-7-901"},"notice":"GroundRules: Original legal text.
