Code, Health - General § 8–406","heading":"","body":"(a) A small halfway house:\n(1) Is deemed conclusively a single–family dwelling for purposes of zoning; and\n(2) Is permitted to locate in all residential zones.\n(b) A large halfway house is deemed conclusively a multifamily dwelling and is permitted to locate in zones of similar density.\n(c) A halfway house is not subject to any special exception, conditional use permit, or procedure that differs from that required for a single–family dwelling or a multifamily dwelling of similar density in the same zone.\n(d) A general zoning ordinance that conflicts with the provisions of this section is superseded by this section, to the extent of the conflict.","path":["Article - Health - General"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghg\u0026section=8-406","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:48Z","sha256":"c264a7b78e1cd85640c1455524ae1f597e10207640c5e22e68799eae393215f5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-general-8-405","next":"us-md/md.-code-health-general-8-407"},"notice":"GroundRules: Original legal text.
