Code, Health Occupations § 1–606","heading":"","body":"(a) Each health occupations board shall adopt specific sanctioning guidelines, including:\n(1) A range of sanctions that is based on historical data or a normative process for each type of violation; and\n(2) A list of mitigating and aggravating circumstances that may be used to decide if a sanction falls within or outside the established range of sanctions.\n(b) Sanctioning guidelines adopted under this section shall:\n(1) Conform to a general framework or incorporate a common set of elements; and\n(2) Be used as a guide for sanctioning licensees and certificate holders in formal and informal proceedings.\n(c) (1) To the extent a health occupations board departs from the sanctioning guidelines adopted under this section, the board shall state its reasons.\n(2) A departure from the guidelines alone is not grounds for any hearing or appeal of any board action.","path":["Article - Health Occupations"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gho\u0026section=1-606","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:58Z","sha256":"7042ba99a5f66e2462e44a1a5c1e93bf89b9ce77f821629afe3fa5b3920545cb","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-occupations-1-605","next":"us-md/md.-code-health-occupations-1-607"},"notice":"GroundRules: Original legal text.
