Code, Health Occupations § 14–5A–06","heading":"","body":"(a) The Committee consists of seven members appointed by the Board as follows:\n(1) Three licensed respiratory care practitioners;\n(2) Three licensed physicians:\n(i) One of whom is a specialist in thoracic surgery;\n(ii) One of whom is a specialist in pulmonary medicine; and\n(iii) One of whom is a specialist in anesthesiology; and\n(3) One consumer member.\n(b) Each member of the Committee licensed by the Board must be in good standing with the Board.\n(c) The consumer member of the Committee:\n(1) Must be a member of the general public;\n(2) May not be or ever have been:\n(i) A respiratory care practitioner;\n(ii) Any other health care professional; or\n(iii) In training to be a respiratory care practitioner or other health professional; and\n(3) May not:\n(i) Participate or ever have participated in a commercial or professional field related to respiratory care;\n(ii) Have a household member who participates in a commercial or professional field related to respiratory care;\n(iii) Have had within 2 years before appointment a financial interest in a person regulated by the Board; or\n(iv) Have had within 2 years before appointment a financial interest in the provision of goods or services to respiratory care practitioners or to the field of respiratory care.\n(d) Each member of the Committee must be a resident of the State.\n(e) (1) The term of a member is 3 years.\n(2) The terms of members are staggered as required by regulation.\n(3) At the end of a term, a member continues to serve until a successor is appointed and qualifies.\n(4) A member who is appointed after a term has begun serves only for the rest of the term and until a successor is appointed and qualifies.\n(5) A member may not serve more than two consecutive full terms.\n(f) (1) From among its members, the Committee shall elect a chair once every 2 years.\n(2) The chair, or the chair’s designee, shall serve in an advisory capacity to the Board as a representative of the Committee.\n(g) A quorum of the Committee consists of four members.","path":["Article - Health Occupations"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gho\u0026section=14-5A-06","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:58Z","sha256":"985b14b3769cfc1069d353d88658e08b3f68d221bc8c1bf302c889b3d34e8a90","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-occupations-14-5a-05","next":"us-md/md.-code-health-occupations-14-5a-07"},"notice":"GroundRules: Original legal text.
