Code, Health Occupations § 7–316.1","heading":"","body":"(a) An action may be maintained in the name of the State or the Board to enjoin:\n(1) The unauthorized practice of mortuary science; or\n(2) Conduct that constitutes a ground for disciplinary action under § 7-315 of this subtitle.\n(b) An action under this section may be brought by:\n(1) The Board;\n(2) The Attorney General; or\n(3) A State’s Attorney.\n(c) An action under this section shall be brought in the county where the defendant:\n(1) Resides; or\n(2) Engages in the practice of mortuary science.\n(d) Proof of actual damage or proof that a person will sustain damage if an injunction is not granted is not required for an action under this section.\n(e) Criminal prosecution for the unauthorized practice of mortuary science under § 7-501 of this title or disciplinary action under § 7-316 of this subtitle does not prohibit an action to enjoin under this section.","path":["Article - Health Occupations"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gho\u0026section=7-316.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:58Z","sha256":"75ee41532cc3ef88de49aa414c287ba52be2de4ddea030d117bcea7b0c8a422f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-occupations-7-316","next":"us-md/md.-code-health-occupations-7-317"},"notice":"GroundRules: Original legal text.
