Code, Health Occupations § 7–602","heading":"","body":"(a) A mortuary transport service shall be issued a permit by the Board before the mortuary transport service may remove and transport human remains in this State.\n(b) (1) To apply for a permit, a mortuary transport service shall submit to the Board:\n(i) An application on the form that the Board requires;\n(ii) An application fee set by the Board; and\n(iii) Evidence that the mortuary transport service is bonded and carries liability insurance that covers each registered transporter employed by the mortuary transport service.\n(2) An application for a permit shall be signed by an individual who is the owner or a co–owner of the mortuary transport service to be issued a permit.\n(c) To qualify for a permit, a mortuary transport service shall satisfy the Board that the mortuary transport service:\n(1) Has complied with all applicable State and local laws;\n(2) Will be owned and operated in accordance with this subtitle; and\n(3) While the mortuary transport service removes and transports human remains, will be held responsible for the treatment of the human remains.\n(d) (1) A permit holder shall use vehicles that have passed an inspection by an inspector designated by the Board while the permit holder removes and transports human remains.\n(2) A permit holder shall employ only registered transporters to remove and transport human remains.\n(e) (1) (i) A permit issued under this subtitle shall expire on the date set by the Board.\n(ii) A permit may not be renewed for a term longer than 2 years.\n(2) A permit holder may renew a permit for additional terms, if the permit holder:\n(i) Submits to the Board:\n1. An application on the form that the Board requires; and\n2. An application fee set by the Board; and\n(ii) Complies with any other renewal requirements established by the Board.\n(f) Signs and advertisements for a mortuary transport service shall display the name of the mortuary transport service as it appears on the permit.","path":["Article - Health Occupations"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gho\u0026section=7-602","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:58:58Z","sha256":"af6d9b786781be25cf3f1607af375657feb9d55bb2a9340f014191cfb104588b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-health-occupations-7-601","next":"us-md/md.-code-health-occupations-7-603"},"notice":"GroundRules: Original legal text.
