Code, Housing and Community Development § 15–109","heading":"","body":"(a) (1) The Baltimore Authority may recognize and engage in collective bargaining with the exclusive bargaining representatives of all appropriate employee bargaining units, including units consisting of:\n(i) maintenance, housekeeping, and technical personnel;\n(ii) administrative and clerical personnel; and\n(iii) supervisory personnel.\n(2) The power under paragraph (1) of this section includes the power of the Baltimore Authority to:\n(i) deal with and, through an exclusive bargaining representative, address grievances and settle disputes;\n(ii) meet and bargain in good faith with an exclusive bargaining representative about wages, hours, working conditions, and other terms and conditions of employment to form a binding labor agreement; and\n(iii) draft and execute labor agreements that last not more than 3 consecutive fiscal years.\n(3) A bargaining unit under paragraph (1) of this subsection may not include:\n(i) confidential employees;\n(ii) contractual employees employed for less than 5 consecutive years;\n(iii) probationary employees;\n(iv) attorneys in the general counsel’s office;\n(v) supervisors, as defined in 29 U.S.C. § 152(11); or\n(vi) employees whose main responsibility is to manage or direct independently the assets and affairs of the Baltimore Authority.\n(b) The Baltimore Authority may engage in binding third-party arbitration of:\n(1) disputes over a term or condition of employment; and\n(2) grievances that relate to the interpretation or application of a written collective bargaining agreement, employment regulation, or work rule.\n(c) The Baltimore Authority may exercise any power that is necessary and appropriate to establish and implement a system of collective bargaining with its employees.","path":["Article - Housing and Community Development"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghs\u0026section=15-109","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:07Z","sha256":"e77c43e2f2285ba2fc8a1a2c060821db18bc9a6656b6b75021a821339990a548","source_id":"us-md","stale":false,"prev":"us-md/md.-code-housing-and-community-development-15-108","next":"us-md/md.-code-housing-and-community-development-16-101"},"notice":"GroundRules: Original legal text.
