Code, Housing and Community Development § 3–206","heading":"","body":"(a) In offering insurance and other forms of credit enhancement, the Department shall adopt eligibility standards that are reasonable to aid in:\n(1) financing the purchase, construction, or rehabilitation of:\n(i) housing projects;\n(ii) special housing facility projects, consisting of the acquisition, rehabilitation, improvement, renovation, construction, financing, or refinancing of a building that:\n1. provides common, shared, or independent living, dining, kitchen, sanitary, and sleeping facilities;\n2. may include supportive services or supervisory live–in personnel for individuals with specialized housing needs; and\n3. may include nonresidential facilities to serve individuals with special needs who may or may not be residents of the special housing facility;\n(iii) rehabilitation projects, as defined in § 4–901 of this article;\n(iv) energy conservation projects;\n(v) solar energy projects;\n(vi) public purpose projects;\n(vii) infrastructure projects; or\n(viii) business projects; and\n(2) the sale or other transfer of an obligation that is:\n(i) denoted as a bond, note, collateralized obligation, grantor trust, conduit, or other form of security or obligation; and\n(ii) backed directly or indirectly by a mortgage or a payment derived from a mortgage.\n(b) The standards adopted under subsection (a) of this section shall ensure that a lender benefiting from insurance or other credit enhancement provided by the Department is responsible and able to service the loan.\n(c) A determination by the Secretary is conclusive if it relates to the eligibility of a project, facility, or undertaking for:\n(1) insurance or other credit enhancement; or\n(2) other action taken by the Department, in its own name or in the name of the Fund, under this subtitle.","path":["Article - Housing and Community Development"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghs\u0026section=3-206","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:07Z","sha256":"18f715edadb048a58d3c49b9274f8480363da8ca422c42d6f59ab9efc19b5305","source_id":"us-md","stale":false,"prev":"us-md/md.-code-housing-and-community-development-3-205","next":"us-md/md.-code-housing-and-community-development-3-207"},"notice":"GroundRules: Original legal text.
