Code, Housing and Community Development § 4–226","heading":"","body":"(a) (1) In connection with property on which it holds a mortgage, the Administration may:\n(i) foreclose on the property;\n(ii) begin an action to protect or enforce a right conferred on the Administration by law or any agreement;\n(iii) bid for and purchase the property at a foreclosure or other sale; and\n(iv) acquire and take possession of the property.\n(2) In an action under this subsection, the Administration may:\n(i) complete, administer, and pay the principal of and interest on an obligation incurred in connection with the property; and\n(ii) dispose of and otherwise deal with the property, so as to protect the interests of the Administration.\n(b) (1) This subsection does not apply to a lien held in connection with a public purpose project.\n(2) The Administration may not lend money on the security of property unless the lien on the property is superior to all other liens, except for:\n(i) a lien for taxes owed to the State or a political subdivision; or\n(ii) an earlier mortgage lien.\n(c) (1) At public or private sale and with or without public bidding, the Administration may sell a mortgage or other obligation that the Administration holds.\n(2) The Administration may retain the servicing rights and charge servicing fees for any mortgage or other obligation the Administration sells.","path":["Article - Housing and Community Development"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghs\u0026section=4-226","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:07Z","sha256":"32f7bbaf4c7b69f2657efb21e9cf9e7e189a280bf8439ce8ec3d8307b28e3c32","source_id":"us-md","stale":false,"prev":"us-md/md.-code-housing-and-community-development-4-225","next":"us-md/md.-code-housing-and-community-development-4-227"},"notice":"GroundRules: Original legal text.
