Code, Human Services § 10–905","heading":"","body":"In accordance with requirements of the federal Older Americans Act, an ombudsman shall have access to:\n(1) long–term care facilities and residents;\n(2) the medical and social records of a resident, if:\n(i) the ombudsman has the permission of the resident or the legal representative of the resident; or\n(ii) the resident is unable to consent and has no legal representative;\n(3) the records that are necessary to investigate a complaint if:\n(i) a legal guardian of the resident refuses to give permission to access the records;\n(ii) the ombudsman has reasonable cause to believe that the guardian is not acting in the best interests of the resident; and\n(iii) the ombudsman obtains the approval of the State Long–Term Care Ombudsman;\n(4) the administrative records, policies, and documents of long–term care facilities to which the residents or members of the general public have access; and\n(5) copies of all licensing and certification records maintained by the Maryland Department of Health or any other State unit with respect to long–term care facilities.","path":["Article - Human Services"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghu\u0026section=10-905","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:17Z","sha256":"c8d509fc626969d363a52112020b85d5ffecd34e7a0359d1cd426db6c11a455a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-human-services-10-904","next":"us-md/md.-code-human-services-10-906"},"notice":"GroundRules: Original legal text.
