Code, Human Services § 5–313","heading":"","body":"(a) Except as provided in subsection (b) of this section and in regulations that the Secretary adopts, a local department may not pay temporary cash assistance to:\n(1) a family that includes an adult who has received more than 60 cumulative months of temporary cash assistance funded wholly or partly by federal funds; or\n(2) a family that includes an adult who:\n(i) has received more than 24 cumulative months of temporary cash assistance funded wholly or partly by federal funds; and\n(ii) is not participating in a work activity.\n(b) The Secretary shall adopt regulations that establish:\n(1) standards and procedures under which a local department may exempt a family from the limitation under subsection (a)(1) of this section because of hardship; and\n(2) a separate State program that:\n(i) is funded entirely from State general funds that may be counted toward any federal maintenance of effort requirement;\n(ii) pays temporary cash assistance to a family that is exempted under item (1) of this subsection but cannot receive federal funds because of federal limitations; and\n(iii) is subject to all FIP requirements under this subtitle.\n(c) The provisions of this section are subject to federal law and regulation.","path":["Article - Human Services"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghu\u0026section=5-313","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:17Z","sha256":"e183dbf147c02a985d59afebef7a9a5624983625ad7917f44a6e135240242faf","source_id":"us-md","stale":false,"prev":"us-md/md.-code-human-services-5-312","next":"us-md/md.-code-human-services-5-314"},"notice":"GroundRules: Original legal text.
