Code, Human Services § 8–715","heading":"","body":"(a) In this part the following words have the meanings indicated.\n(b) (1) “Residential child care program” includes a facility or program that:\n(i) provides a residential environment such as:\n1. a program with a wilderness or outdoor experience, expedition, or intervention;\n2. a boot camp experience or other experience designed to simulate characteristics of basic military training for correctional regimes;\n3. an educational or therapeutic boarding school; or\n4. a behavioral modification program; and\n(ii) serves children who have a history of diagnosis of:\n1. an emotional, behavioral, or mental health disorder;\n2. a substance misuse or use disorder, including alcohol misuse or use disorder; or\n3. an intellectual, developmental, physical, or sensory disability.\n(2) “Residential child care program” does not include:\n(i) a hospital licensed by the State;\n(ii) a detention facility licensed by the State;\n(iii) a youth correctional facility;\n(iv) a substance abuse treatment facility;\n(v) a foster family home:\n1. that provides 24–hour substitute care for children placed away from their parents or guardians;\n2. for which the State child welfare services agency has placement and care responsibility; and\n3. that is licensed and regulated by the State as a foster family home; or\n(vi) any other secure facility.\n(c) “Youth transportation company” means a business that specializes in transporting a child to a residential child care program.","path":["Article - Human Services"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ghu\u0026section=8-715","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:17Z","sha256":"51f101d0ffb7023bf768fbaab6ddda2b4c7f2e970e829f14568a3cf4f35616f4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-human-services-8-712","next":"us-md/md.-code-human-services-8-716"},"notice":"GroundRules: Original legal text.
