Code, Insurance § 12–207","heading":"","body":"(a) Each statement by or on behalf of the insured or annuitant in an application for the issuance, renewal, or reinstatement of a life insurance or health insurance policy or annuity contract is considered to be a representation and not a warranty.\n(b) A misrepresentation, omission, concealment of facts, or incorrect statement does not prevent a recovery under the policy or contract unless:\n(1) the misrepresentation, omission, concealment, or statement is fraudulent or material to the acceptance of the risk or to the hazard that the insurer assumes; or\n(2) if the correct facts had been made known to the insurer, as required by the application for the policy or contract or otherwise, the insurer in good faith would not have:\n(i) issued, reinstated, or renewed the policy or contract;\n(ii) issued the policy or contract in as large an amount or at the same premium or rate; or\n(iii) provided coverage with respect to the hazard resulting in the loss.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=12-207","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"62ae262bd0d6d928d14d19addcee9893491f3f5099ddf7e87b612c0d8f6436de","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-12-206","next":"us-md/md.-code-insurance-12-208"},"notice":"GroundRules: Original legal text.
