Code, Insurance § 15–145","heading":"","body":"(a) (1) In this section the following words having the meanings indicated.\n(2) “Health savings account” has the meaning stated in § 223 of the Internal Revenue Code.\n(3) “High deductible health plan” has the meaning stated in § 223 of the Internal Revenue Code.\n(b) A health savings account is established on the first day that an individual becomes covered by a high deductible health plan.\n(c) The health savings account shall be opened with a trustee or custodian within the time period prescribed by law, without extensions, for filing a federal income tax return for the year in which the health savings account is established.\n(d) A health savings account is established regardless of a transfer of cash or other property to the account and, unless required by the trustee or custodian, it is not necessary for any party to sign a health savings account trust or custodial agreement regarding the health savings account.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=15-145","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"58de742317647e524074faf29370c3aa4481de80b51e0e26e6ece14fccaf3d68","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-15-144","next":"us-md/md.-code-insurance-15-146"},"notice":"GroundRules: Original legal text.
