Code, Insurance § 15–845","heading":"","body":"(a) This section applies to:\n(1) insurers and nonprofit health service plans that provide coverage for prescription eye drops under health insurance policies or contracts that are issued or delivered in the State; and\n(2) health maintenance organizations that provide coverage for prescription eye drops under contracts that are issued or delivered in the State.\n(b) An entity subject to this section shall provide coverage for a refill of prescription eye drops:\n(1) in accordance with guidance for early refills of topical ophthalmic products provided to Medicare Part D plan sponsors by the Centers for Medicare and Medicaid Services; and\n(2) if:\n(i) the prescribing health care practitioner indicates on the original prescription that additional quantities of the prescription eye drops are needed;\n(ii) the refill requested by the insured does not exceed the number of additional quantities indicated on the original prescription by the prescribing health care practitioner; and\n(iii) the prescription eye drops prescribed by the health care practitioner are a covered benefit under the policy or contract of the insured.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=15-845","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"e04e35c8198371d80b2883bbbc8830920e44d278e53bfc754fefd82911feed70","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-15-844","next":"us-md/md.-code-insurance-15-846"},"notice":"GroundRules: Original legal text.
