Code, Insurance § 2–401","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Fraud Division” means the Insurance Fraud Division in the Administration.\n(c) “Insurance fraud” means:\n(1) a violation of Title 27, Subtitle 4 of this article;\n(2) theft, as set out in §§ 7–101 through 7–104 of the Criminal Law Article:\n(i) from a person regulated under this article; or\n(ii) by a person regulated under this article or an officer, director, agent, or employee of a person regulated under this article;\n(3) a violation of § 9–1106 of the Labor and Employment Article; or\n(4) any other fraudulent activity that is committed by or against a person regulated under this article and is a violation of:\n(i) Title 1, Subtitle 3 of the Agriculture Article;\n(ii) Title 19, Subtitle 2 or Subtitle 3 of the Business Regulation Article;\n(iii) Title 14, Subtitle 29, § 11–810, or § 14–1317 of the Commercial Law Article;\n(iv) the Criminal Law Article other than Title 8, Subtitle 2, Part II or § 10–614;\n(v) Title 12, Subtitle 9 of the Financial Institutions Article;\n(vi) § 14–127 of the Real Property Article;\n(vii) § 6–301 of the Alcoholic Beverages and Cannabis Article;\n(viii) § 109 of the Code of Public Local Laws of Caroline County;\n(ix) § 4–103 of the Code of Public Local Laws of Carroll County; or\n(x) § 8A–1 of the Code of Public Local Laws of Talbot County.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=2-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"6b16b70c009fd1b3c6a082d2bb764b3d12b289c681f97f697f35bb3d62ef9f4b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-2-305","next":"us-md/md.-code-insurance-2-402"},"notice":"GroundRules: Original legal text.
